Terms of Service

This is a template. Have a lawyer review it for your jurisdiction before launch. The medical-disclaimer and limitation-of-liability sections are particularly important and should be tightened to local law.

These Terms of Service ("Terms") govern your access to and use of the NutriMatch mobile application (the "App") and the website at nutrimatch.org (the "Site"). By creating an account or using the App, you agree to these Terms.

1. The service

NutriMatch is a wellness journal designed to help people track foods, symptoms, and patterns related to food intolerances. It is informational only. It is not medical advice, not a diagnostic tool, and not a medical device under FDA, EMA, MDR, or any other regulatory framework.

2. Medical disclaimer

You must read and accept the in-App Health & Safety Disclaimer before using NutriMatch. In summary:

Nothing in the App constitutes medical advice, diagnosis, or treatment.
AI-generated trigger assessments and monthly reports are heuristic, not clinically validated.
Always consult a qualified healthcare professional, allergist, or registered dietitian before making dietary decisions — particularly if you have a diagnosed allergy, intolerance, coeliac disease, or any other medical condition.
In case of a severe allergic reaction (anaphylaxis), call emergency services immediately.

3. Eligibility

You must be at least 16 years old to use NutriMatch. If you are under the age of majority in your country, you may only use the App with the consent of a parent or guardian.

4. Your account

You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. Notify us immediately at support@nutrimatch.org if you suspect unauthorised access.

5. Subscriptions, billing, and refunds

NutriMatch is offered on weekly, monthly, or yearly subscription plans. Subscriptions are billed and managed by Apple's App Store or Google Play. They renew automatically until cancelled, and we have no ability to refund subscription charges directly — refund requests must be made via your store account:

You may cancel your subscription at any time from your device's subscription settings. Cancelling stops the next renewal; access continues until the end of the current paid period.

Free trials: if you start a free trial and do not cancel before the trial ends, you will be charged the full subscription price. You can manage trials and cancellations in your device's subscription settings.

6. Acceptable use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms.
Attempt to gain unauthorised access to other users' accounts or our systems.
Reverse-engineer, decompile, or attempt to derive the source code of the App, except where permitted by law.
Use the App to transmit malware, spam, or content that is harmful, defamatory, or illegal.
Resell, sublicense, or otherwise commercially exploit the App or its content without our written permission.

7. Intellectual property

The App, the Site, and all content created by us — including the brand, logo, copy, designs, and trigger taxonomy — are owned by NutriMatch and protected by copyright and trademark law. We grant you a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial use in accordance with these Terms.

The data you log (your meals, symptoms, photos, profile) belongs to you. By logging it you grant us the limited licence required to store, process, and analyse it for the purpose of providing the App's features.

8. Third-party services

The App relies on third-party services including Apple, Google, Supabase, RevenueCat, Anthropic, Spoonacular, OpenFoodFacts, and OCR.space. Their respective terms apply to their portions of the service. We are not responsible for outages or changes in their services.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any AI analysis is accurate or complete.

10. Limitation of liability

To the maximum extent permitted by applicable law, NutriMatch and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with your use of the App — even if we have been advised of the possibility of such damages. In jurisdictions where such limitations are not permitted, our liability is limited to the amount you have paid us in the past 12 months.

You expressly acknowledge that NutriMatch's outputs are heuristic and that any health-related decision must be made in consultation with a qualified clinician.

11. Termination

You may stop using the App at any time and delete your account from Settings → Delete Account. We may suspend or terminate your access if you breach these Terms, abuse the service, or attempt to defraud the subscription system.

12. Governing law

These Terms are governed by the laws of [your country/state — please complete with a lawyer], without regard to its conflict-of-law principles.

13. Changes

We may update these Terms from time to time. The "last updated" date above will reflect the most recent revision. Continued use of the App after changes constitutes acceptance of the new Terms.
